Mandatory Reporting

The website has information about how to report suspected child maltreatment, information about mandatory reporting requirements, and Hotline information.  If anyone is aware of additional information that should be posted here, please contact Bill Mitchell at Mitchell Insurance, Inc.  Mandated reporters include "An individual paid or unpaid, who, on the basis of the individual's role as an integral part of a regularly scheduled program, activity or service, is a person responsible for the child's welfare or has direct contact with children," and therefore explicitly includes volunteers.  More information on mandatory reporting and the ability to make reports can be found on the PA Child Welfare Portal.

'A Clear Path to Safeguarding Your Religious Institution'

Trigger Language that must be in your Association Bylaws

As discussed at the seminar, the protection provided in a D&O policy is 'triggered' by the Corporation's obligation to indemnify its officers and directors, but the only way that a Corporation (esp. a non-profit) is obligated is if the bylaws themselves state that they are obligated.  This leads to the need for an indemnification provision in the bylaws themselves.  According to lawforchange.org "Pennsylvania law permits a corporation to indemnify any person for attorneys' fees, judgments, fines and amounts paid in settlement actually and reasonably incurred by that person in an action or proceeding arising out of that person's service to the corporation or position within the corporation. This provision applies as long as the person acted in good faith and in a manner he reasonably believed to be in the best interests of the corporation (for criminal actions, the person had no reason to believe his conduct was unlawful). Nonprofit corporations are statutorily mandated to indemnify representatives of the corporation who are successful on the merits for expenses actually and reasonably incurred by them. Members of a nonprofit corporation will not be personally liable for any obligation or liability of the corporation or for the acts of any member or representative of the corporation. However, a member may be liable to the corporation to the extent of any unpaid portion of capital contributions, membership dues or assessments which the corporation has imposed upon its members."

Darkness to Light Training offered by Big Brothers / Big Sisters

As a participant in the recent Butler Area Compliance Workshop sponsored by Mitchell Insurance, inc., you have shown that you have a significant interest in doing whatever it takes to ensure the safety of our children and protect them from all forms of abuse.  

Darkness to Light (D2L) is a nonprofit organization whose mission is to teach adults how to prevent, recognize, and react responsibly to child sexual abuse, so that more children have a chance to grow up happy and healthy. Their award-winning prevention training program, Stewards of Children®, uses a practical, five-step approach to provide adults with the tools to protect the children in their lives and youth serving organizations. It approaches the difficult topic of child sexual abuse in a way that is empowering, not fear-focused or depressing.

As Director of Big Brothers Big Sisters of Butler County, I have a concerted interest in protecting the welfare of all children. I am also a Darkness to Light authorized facilitator and I believe this program would benefit your organization. Stewards of Children is the only evidence-informed, third-party evaluated prevention training program of its kind. It is available in all 50 U.S. states, 16 additional countries, and three languages. D2L authorized program facilitators represent a wide variety of organizations including places of worship, youth centers, sports leagues, child care providers, schools, businesses, state and local agencies, law enforcement, and our armed services.

CPR and FirstAid Training offered 'at cost'

Tracy Mitchell in our office is a Red Cross Certified Trainer in CPR and FirstAid and is willing to train your organization 'at cost'.    The American Red Cross charges $19 per person for the instructor to submit and receive certifications for individuals in CPR, or $29 for CPR with First Aid. We need to cover this cost, plus the cost of supplies. So, you can have your employees American Red Cross certified for $30/person for CPR or $45/person for CPR & First Aid. This can be at your facilities or our office, on your schedule, with up to 8 people per class.  To arrange for either CPR or CPR and FirstAid training, please emailTracy at Tracy@Since1849.com or contact her by phone at (412) 465-0264 and identify yourself as a participant in the PA Child Protection Law workshop.
